Success Story – Triple Wins for Real Estate Investor Saves Client Millions

Background:

As a real estate investment, our client purchased an undeveloped subdivision comprised of 110 lots. After the deal closed, a third party who had previously worked on similar developments, and contacted our client regarding the investment opportunity, sued our client for 4 million in damages plus a 50% interest in asset. 


Challenges:

Lavelle Law represented the Defendants in this lawsuit wherein the Plaintiff was seeking a preliminary injunction as well as monetary damages of over 4 million under a variety of legal theories. 



Result: 

At the outset of the case, Lavelle Law’s first victory was the Court’s denial of Plaintiff’s request for a TRO and preliminary injunction against the Defendants. This success came after a multiple-day evidentiary hearing with witnesses, testimony, and evidence provided to the Court, and at the conclusion, the Court denied the Plaintiff’s request for a TRO and preliminary injunction against the Defendants. 


Lavelle Law’s second victory came when it filed a Motion for Summary Judgment on the Defendants' behalf seeking judgment in favor of Defendant on all claims filed by Plaintiff. Again, the Court ruled in favor and entered judgment in favor of Defendant on all claims except one count for unjust enrichment. 


Lavelle Law’s final victory was winning at trial on the one remaining cause of action asserted by the Plaintiff against the Defendants. This resulted in a judgment being entered in the Defendants’ favor and against the Plaintiff. Despite being sued for millions and half of its ownership interest in the development, Lavelle Law’s clients paid no money to Plaintiff and retained 100% ownership interest in the subdivision.
