This Privacy Policy applies to our websites, including www.lavellelaw.com, and our other websites, and the services available through our websites (together, our "Sites"). Some of our websites may include additional or different privacy policies, and if a different privacy policy applies, this will be clearly disclosed to you. This Privacy Policy is intended to disclose how Lavelle Law Ltd. ("Lavelle Law" herein) collects, uses and discloses personal information about users of our Sites, as well as to explain the choices and rights individuals have regarding their personal information.


You acknowledge that this Privacy Policy is part of our site Terms and Conditions of Use, and by accessing or using our Sites, you agree to be bound by all of its terms and conditions.  If you do not agree to these terms, you are prohibited from accessing or using the Sites.


1. Information we collect


We collect information directly from individuals online, as well as automatically through the use of our Sites.


You must be at least 18 years old to use the Sites.  We do not knowingly collect, use or disclose personal information about users that are under 18 years of age.


  • Information collected directly
    We may collect personal information about you directly from you, generally including, without limitation, your:
  • Name, company name and title/position,
  • Email address, phone number, mailing address and contact details,
  • Contact preferences and interests, and
  • Other information related to your request or inquiry.


This information is not collected unless you voluntarily provide it to us.  You provide this information to us when you take actions such as (a) submitting a message through the “Contact Us” section of the Sites; (b) sending email messages, submitting forms or transmitting other information by telephone or letter; (c) signing up for our mailing lists or registering for events we host or sponsor, (d) posting comments on our Sites, or (e) otherwise voluntarily providing us with your information. If there is a portion of the Sites that requests information and you do not wish to provide that information, then you are not required to do so; simply stop your use of that portion of the Sites.


  • Automatically collected information
    We use cookies, log files, and other tracking technologies to automatically collect information when users access or use the services or visit our Sites, such as an IP address, general location information, domain name, page views, a date/time stamp, browser type, device type, device ID, Internet service provider ("ISP"), clickstream data, and other information about the links clicked and features used.   • Information received from third parties
    We may collect or receive information about individuals from service providers and other third parties such as our clients, representatives and professional advisers, content providers, government authorities and public sources and records. 


2. Use of personal information


We generally use the personal information you provide to respond to your request or inquiry, if applicable, and in the ordinary course of conducting our business, including, without limitation, the following:


  • Providing support and services
    To provide and operate our Sites, communicate with you about your use of the Sites, provide troubleshooting and technical support, respond to your inquiries, fulfill your orders and requests, process your payments, communicate with you, and for similar service and support purposes.
  • Responding to your requests
    To respond to your inquiries and consider your request or application (e.g., if you have submitted a resume or other application information online or by email, we will use it as part of the application review process).
  • Personalization
    To tailor content we may send or display on the Sites, including to offer location customization and personalized help and instructions, and to otherwise personalize your experiences.
  • Newsletters, mailing lists and direct marketing
    For direct marketing purposes, including to send you newsletters, client alerts and information we think may interest you. If you are located in a jurisdiction that requires opt-in consent to receive electronic marketing messages, we will only send you such messages if you opt-in to receive them.
  • Analytics and improvement
    To better understand how users access and use the Sites, and our other products and offerings, and for other research and analytical purposes, such as to evaluate and improve our services and business operations and to develop services and features.
  • Protect our legal rights and prevent misuse
    To protect the Sites and our business operations; to prevent and detect fraud, unauthorized activities and access, and other misuse; where we believe necessary to investigate, prevent or take action regarding illegal activities, suspected fraud, situations involving potential threats to the safety or legal rights of any person or third party, or violations of our Terms of Use or this Privacy Policy.
  • Comply with legal obligations
    To comply with the law or legal proceedings. For example, we may disclose information in response to subpoenas, court orders, and/or other lawful requests by regulators and/or law enforcement, including responding to national security or law enforcement disclosure requirements.
  • General business operations
    Where necessary, for the administration of our general business, accounting, recordkeeping and legal functions.
  • Anonymous and de-identified information
    We create and use anonymous and de-identified information to assess, improve and develop our business, products and services, and for similar research and analytics purposes.


Lavelle Law will primarily use your personal information to provide services to you, as our client or a party inquiring about our legal and related services (the “Services”), as required by our agreements with you.  Lavelle Law may also use your personal information to enhance the operation of our Sites, improve our marketing and promotional efforts, statistically analyze use of the Sites, improve our service offerings, and customize our Sites’ content, layout, and services.  Lavelle Law may use your personal information to deliver information to you and to contact you regarding administrative notices.  Lavelle Law may also use your personal information to resolve disputes, troubleshoot problems and enforce our agreements with you, including our Terms and Conditions of Use and this Privacy Policy.


3. Disclosure of personal information


We do not sell, trade, or rent your personal information to others.  We may provide some of our services through contractual arrangements with affiliates, services providers, partners and other third parties.  We and our service partners use your personal information to operate our Sites and to deliver their services.  For example, we may share personal information with the following categories of third parties:


  • Third party service providers that provide services to us or to whom we outsource certain services, such as data hosting or software or technology services,
  • Other professional advisers, such as lawyers and accountants,
  • Government and/or regulatory authorities,
  • Professional indemnity insurers, and
  • Regulators, tax authorities and/or corporate registries.


In addition, we may disclose personal information to other third parties under the following circumstances:

  • Business transfers
    As part of any merger, sale and transfer of our assets, acquisition or restructuring of all or part of our business, bankruptcy, or similar event, including related to due diligence conducted prior to such event where permitted by law.
  • Legally required
    If we are required to do so by law (e.g., to law enforcement, courts or others, in response to a subpoena or court order).
  • Protect our rights
    Where we believe it necessary to respond to claims asserted against us, comply with legal processes (e.g., subpoenas or warrants), enforce or administer our agreements and terms, or for fraud prevention, risk assessment, investigation, and to protect the rights, property or safety of Lavelle Law, our clients and customers, or others.


We may also share aggregate or de-identified information with third parties for research, marketing, analytics and other purposes, provided such information does not identify a particular individual.


We will encourage our service partners to adopt and post privacy policies.  However, the use of your personal information by our service partners is governed by the privacy policies of those service partners, and is not subject to our control.


4. Cookies and similar devices


We and our service providers use cookies, log files and other mechanisms to gather information about your use of our Sites.


  • Cookies
    Cookies are alphanumeric identifiers that we transfer to your computer's hard drive through your web browser for record-keeping purposes. Our cookies may store randomly assigned user identification numbers, the country where you are located, and other information.  The cookies may make your use of the Sites easier, make the Sites run more smoothly, and help us to maintain the Sites’ security.  If the Sites are using cookies, you are always free to decline cookies if your browser permits. Most web browsers automatically accept cookies, but if you prefer, you can edit your browser options to block them in the future. The “Help” portion of the toolbar on most browsers will tell you how to prevent your computer from accepting new cookies, how to have the browser notify you when you receive a new cookie, or how to disable cookies altogether.
  • Log files
    Most browsers collect certain information, such as your IP address, device type, screen resolution, operating system version, and Internet browser type and version. This information is gathered automatically and stored in log files.
  • Third-party analytics
    We may also use automated devices and applications to evaluate the use of our services, such as:

We use these tools to gather non-personal data about users to help us improve our services and user experiences. These analytics providers may use cookies and other technologies to perform their services, and may combine the information they collect about you on our Sites with other information they have collected for their own purposes. This Privacy Policy does not cover such uses of your data by third parties.


  • Do-not-track signals
    Our Sites do not respond to do-not-track signals. You may, however, disable certain tracking as discussed above (e.g., by disabling cookies). 


5. Direct marketing


As noted, we may send periodic promotional emails to you and, where required by law, we will obtain your consent to do so. You may opt out of such communications at any time by following the opt-out instructions contained in our emails or email us at info@lavellelaw.com. If you opt out of receiving emails about recommendations or other information we think may interest you, we may still send you emails about your account or any services you have requested or received from us.


6. Access and correction


If you would like to review the personal information we have collected about you via the Sites, please contact us at info@lavellelaw.com. Please include your name, address, and/or email address when you contact us.   


You may ask us to update, remove, or delete your personal information at any time by sending an appropriate request to info@lavellelaw.com.  We encourage you to promptly update your Personally Identifiable Information if it changes. Note that it may be impossible to completely delete your information without certain residual information saved in backups.


7. Direct Marketing


We may, from time to time, send you emails regarding our products and services.  In addition, if you indicated that you are interested in receiving offers or information from us and our partners, we may occasionally send you direct mail about products and services that we feel may be of interest to you.  Only Lavelle Law (or agents working on behalf of Lavelle Law and under confidentiality agreements) will send you these direct mailings and only if you indicated that you do not object to these offers.  If you do not want to receive such mailings, simply send an appropriate request to info@lavellelaw.com.


8. Third-party websites and links


Except as otherwise discussed in this Privacy Policy, this document only addresses the use and disclosure of information we collect from you.  Our Sites contain links to other sites whose information practices may be different than ours. Other sites accessible through our Sites have their own privacy policies and data collection, use and disclosure practices.  Please consult each such site's privacy policy.  We are not responsible for the policies or practices of third parties.  Additionally, other companies that place advertisements on our Sites may collect information about you when you view or click on their advertising through the use of cookies.  We cannot control this collection of information.  You should contact these advertisers directly if you have any questions about their use of the information that they collect.


9. Our commitment to security


At our Sites you can be assured that your personal information is secure, consistent with current industry standards.  We employ security measures to prevent unauthorized access to information that we collect online. The importance of security for all personal information associated with our users is of the utmost concern to us.  Your personal information resides on secure servers to which only selected Lavelle Law personnel and contractors have access via password.  We make every effort to prevent unauthorized parties from viewing such information when it is transmitted to us.


Unfortunately, no data transmission over the Internet or any wireless network can be guaranteed to be 100% secure.  As a result, while we strive to protect your personal information, you acknowledge that:  (a) there are security and privacy limitations of the Internet that are beyond our control; (b) the security, integrity and privacy of any and all information and data exchanged between you and us through the Sites cannot be guaranteed; and (c) any such information and data may be viewed or tampered with in transit by a third party.

11. Revisions to our Privacy Policy


We reserve the right to revise this Privacy Policy or any part of it at any time.  Such changes, modifications, additions or deletions shall be effective immediately upon notice thereof, which may be given by means including, but not limited to, issuing an email to your email address on file with us or by posting the revised Privacy Policy on this page.  You acknowledge and agree that it is your responsibility to review this Privacy Policy when you access the Sites and to be aware of any modifications.  Your continued use of the Sites after such modifications will constitute your:  (a) acknowledgment of the modified Privacy Policy; and (b) agreement to abide and be bound by the modified Privacy Policy.


12. Additional Privacy Information for California Residents


This section of our Privacy Policy (the "California Notice") provides additional information for California residents, as required under the California Consumer Privacy Act of 2018 ("CCPA"). This section reflects our good faith understanding of the CCPA and our data practices as of January 1, 2020, but the CCPA’s implementing regulations are not yet final, and there remain differing interpretations of the law. Accordingly, we may update information regarding our data practices and your rights, modify our methods for responding to your requests, and/or supplement our response to your requests, as we continue to develop our compliance program to reflect the evolution of the law and our understanding of how it relates to our data practices.

13. Users in the European Union


If you are a user in the European Union, you have certain rights pertaining to your personal data under the General Data Protection Regulation 2016/679 (“GDPR”). The legal basis for the processing of the information hereunder is one or more of the following: (a) your consent to the processing of your personal data for the specific purposes set forth herein, including consent provided by sending a message with your personal information using the Sites’ “Contact Us” section; (b) processing may be necessary for the performance of a contract with you or in order to take steps at your request prior to entering into a contract; (c) processing may be necessary for compliance with a legal obligation to which we are subject, including an obligation to keep records of certain transactions for accounting or compliance purposes; (d) processing may be necessary in order to protect your vital interests, including your interest in obtaining additional information related to our products or services; (e) processing is necessary for the purposes of the legitimate interests pursued by Lavelle Law or third parties, including our interest in retaining information about our clients for financial, planning, marketing purposes, and other legitimate purposes.


We store the personal data for no longer than is necessary from the last date of contact, unless a longer period of time is required by law or requested by a user.


You have the right to data erasure under GDPR and have your contact and site usage information deleted.  Please email info@lavellelaw.com to request information deletion.  You have the right to access the information we have collected about you and your use of our website in a machine-readable electronic format within a reasonable time of making said request. Please email info@lavellelaw.com to access this information. You have the right to modify your personal data that we have collected to ensure that it is up-to-date and accurate.


In addition to other rights provided herein you have the following rights:; the right to rectify errors in your personal data; the right to know how your personal data will be used; the right to know how long your personal data will be stored; the right to know with whom your personal data is being shared; the right to know the source of any personal data about you for which your informed consent was not given; the right to reject “profiling” – shaping content that is presented to you based on personal data collected from you; the right to object to or restrict data processing by us; the right to data portability; and right to withdraw consent to use by us of your personal data.
