Background:
Our client contacted us for advice regarding the termination of a long-time employee who was failing to meet performance standards. Our client already provided several accommodations for this employee, but they still were not meeting the mark.
Challenges:
Although all employees in Illinois are at-will employees and can be terminated for any reason, the reason cannot be discriminatory. In this situation, we needed to ensure that the employee our client terminated was not going to bring any legal action later as a result of the termination.
Result:
Our client received the result they wanted. We drafted a termination letter on behalf of our client, and the employee did not dispute the grounds for termination.
