Success Story – Appeal Win Results in Settlement for Client

Background:

Our client owned a strip mall that was largely destroyed in a fire. While the insurance covered most of the rebuild, it did not cover business income losses, which the insurance agent had assured the client their policies contained. 


Challenges:

Lavelle Law represented the Plaintiff in this lawsuit against the insurance company, insurance brokers, and insurance agent. Plaintiff’s Amended Complaint was dismissed in the trial court and Lavelle Law, Ltd. appealed to the Appellate Court. 


Result: 

Lavelle Law won the appeal on behalf of the Plaintiff and the case was sent back to the trial court for further proceedings. After the matter was sent back to the trial court, the case was settled in Plaintiff’s favor for an amount acceptable to Plaintiff to resolve its claims.
