Obligación de una evaluación médica en casos de tutela de Illinois

Si busca la tutela de un ser querido en Illinois, uno de los pasos más importantes para obtener cartas de mandato de un juez es cumplir con los estándares establecidos en la Ley de Sucesiones (la "Ley") con respecto a la Evaluación e Informe de un Médico ("Evaluación" e "Informe"). La Evaluación debe ser realizada por una persona calificada y el Informe debe incluir lo siguiente:


  • Una descripción de la naturaleza y el tipo de discapacidad del individuo y una evaluación de cómo la discapacidad afecta al individuo para tomar decisiones o funcionar de forma independiente.
  • Una evaluación de la condición mental y física del individuo.
  • Una opinión sobre si se necesita una tutela para la persona discapacitada.
  • Una recomendación de los arreglos de vivienda mas adecuados para la persona discapacitada.
  • Cualquier y toda la información perteneciente a la persona o personas que han realizado las evaluaciones.

Sin una Evaluación y posterior Informe que cumpla con la Ley, no se puede obtener la tutela sobre la persona o patrimonio de un individuo. Pero, ¿qué sucede cuando encuentra obstáculos al tratar de obtener este Informe?


Algunas de las mayores dificultades que uno puede encontrar para obtener un Informe en un asunto de tutela son la cooperación de la persona discapacitada propuesta y la disposición o capacidad de los proveedores de atención médica de la persona discapacitada propuesta. Incluso si la persona discapacitada propuesta ha sido internada en un centro para pacientes hospitalizados, muchos profesionales médicos no están dispuestos a realizar una Evaluación y completar un Informe debido a problemas de responsabilidad. Combine esto con una persona discapacitada propuesta que no está dispuesta a someterse a una evaluación y las perspectivas de obtener un informe pueden parecer casi imposibles. Sin embargo, no tema, ya que tanto la Ley como las Reglas de la Corte Suprema de Illinois proporcionan una base por la cual un tribunal de tutela puede obligar a la evaluación de una persona discapacitada propuesta.


Cuando una Petición de Tutela no va acompañada de un informe, la Sección 11a-9(b) de la Ley requiere que el tribunal ordene que una persona calificada realice las Evaluaciones y que se prepare y presente un Informe ante el tribunal al menos diez (10) días antes de la audiencia de tutela. Además, la regla 215(a) de la Corte Suprema de Illinois permite que un tribunal requiera que la persona discapacitada propuesta se someta a un examen físico o mental por parte de un profesional autorizado en una acción en la que la condición física o mental de una persona esté en controversia.


A pesar de la autoridad legal antes mencionada para exigir una evaluación e informe en Illinois, hay escasez de jurisprudencia y precedentes legales sobre estos temas y es posible que muchos jueces de tutela de Illinois ni siquiera sepan de su existencia.
